Meaning
Licensing instrument residing within the itar framework as the primary application for the permanent export of unclassified defense articles and technical data. The dsp-5 is issued by the directorate of defense trade controls to authorize the transfer of sensitive technologies to foreign entities. It defines the specific scope of the transaction and the parties allowed to receive the information.
Authorization Scope
Approval of this license allows a company to ship physical goods or transmit engineering drawings to a designated foreign end user. The dsp-5 specifies the quantity, the value and the specific part numbers that are cleared for export. Any deviation from these parameters requires a formal amendment to the original filing.
Documentation of the end use must be attached to the application.
Transactional Validity
Licenses are generally valid for a period of four years unless the value of the export is reached sooner. The dsp-5 remains active until the last item is shipped or the time limit expires, at which point the license is returned to the state department.
Record Requirement
Exporters must maintain a complete log of all shipments made under the authority of the license. The dsp-5 number must appear on the electronic export information filing and the commercial invoice to ensure the customs authorities can verify the legality of the shipment.
